Gun Trust Experts LLC sells legal document templates for NFA firearms trusts, including the product known as "The Liberty Preservation Trust" (the "Trust Document"). Our products are templates and educational materials, NOT legal advice. No attorney-client relationship is created by your purchase, download, or use of any product.
Your purchase grants you a personal, non-transferable, non-exclusive, revocable license to use one (1) copy of the Trust Document for your own personal or family use. Specifically:

You agree to indemnify, defend, and hold harmless Gun Trust Experts LLC, its owners, members, managers, employees, agents, licensors, and affiliates (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your purchase, use, or misuse of the Trust Document; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or ordinance; (d) any action taken by any trustee, beneficiary, or successor trustee under your completed trust; (e) any claim that your use of the Trust Document infringed or violated the rights of a third party; or (f) any inaccurate information you provided during the purchase or document generation process.
We offer a 30-day satisfaction guarantee. If you are not satisfied with your purchase, contact us within 30 days for a full refund. Refund requests after 30 days will be considered on a case-by-case basis. Issuance of a refund does not grant any continued license to use the Trust Document, and you must destroy all copies upon receiving a refund.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUN TRUST EXPERTS LLC, ITS OWNERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR PURCHASE OR USE OF OUR PRODUCTS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, LEGAL FEES, FINES, PENALTIES, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR SPECIFIC REQUIREMENTS, THAT THEY WILL BE ERROR-FREE OR COMPLETE, OR THAT THEY COMPLY WITH THE LAWS OF ANY PARTICULAR JURISDICTION. LAWS CHANGE FREQUENTLY; THIS DOCUMENT MAY NOT REFLECT THE MOST CURRENT LEGAL REQUIREMENTS AT THE TIME OF YOUR USE.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Trust Document, or your use of our products ("Dispute") shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as provided below. The arbitration shall be conducted by a single arbitrator in Sioux Falls, South Dakota, or at a location mutually agreed upon by the parties. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
YOU AND GUN TRUST EXPERTS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Gun Trust Experts LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. YOU ALSO WAIVE YOUR RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING UNDER THESE TERMS.
These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in South Dakota, and you waive any objection to venue or jurisdiction in such courts.
By purchasing our products, you acknowledge and agree that: (a) you are solely responsible for compliance with all applicable federal, state, tribal, territorial, and local laws and regulations governing NFA items and firearms; (b) you understand that NFA violations carry severe criminal penalties including imprisonment of up to 10 years and fines of up to $250,000; (c) you will not use the Trust Document for any illegal purpose; and (d) you will consult with appropriate legal counsel regarding your specific legal obligations.
Gun Trust Experts LLC shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government action, changes in law or regulation, pandemic, internet or telecommunications failures, or any other event outside our reasonable control.
Gun Trust Experts LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of our website or products after any modification constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
These Terms, together with our Privacy Policy and Legal Disclaimers, constitute the entire agreement between you and Gun Trust Experts LLC regarding your purchase and use of our products and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
The failure of Gun Trust Experts LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Gun Trust Experts LLC.
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Gun Trust Experts LLC may assign these Terms without restriction.

When you purchase a Premium plan, we collect the information you provide in the intake form (name, address, trustee information, beneficiary information, and firearms information) solely for the purpose of generating your personalized trust document. When you visit our website, we may collect standard web server logs (IP address, browser type, pages visited) for security and analytics purposes.
All payment processing is handled by Stripe, Inc. We never see, store, or have access to your credit card number, CVV, or other payment card details. Stripe's privacy policy governs their handling of your payment information. We may receive from Stripe your name, email address, billing address, and transaction details for order fulfillment and record-keeping purposes.
Form data you provide is used exclusively for generating your trust document. This data is processed in memory during document generation and is NOT permanently stored in any database, file system, or log. Once your document is generated and downloaded, we do not retain your personal information. We may retain transaction records (purchase date, amount, product tier) for accounting, tax reporting, and dispute resolution purposes.
We do not sell, rent, trade, or otherwise share your personal information with any third parties, except: (a) with Stripe for payment processing; (b) if required by law, subpoena, or court order; or (c) to protect our rights, property, or safety, or the rights, property, or safety of others.
All communications with our website are encrypted via HTTPS/TLS. Form data is transmitted securely and processed server-side. We implement reasonable security measures to protect against unauthorized access. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
We retain transaction records for the period required by applicable tax and accounting laws (generally 7 years). Personal information provided in intake forms is not retained after document generation. We may retain anonymized, aggregated usage data for analytics purposes.
You may request access to, correction of, or deletion of your personal information by contacting us. Since we do not retain intake form data, there is generally no personal data to delete beyond transaction records, which we are required to maintain for legal and accounting purposes.
We use only essential cookies required for website functionality. We do not use tracking cookies or share data with advertising networks.
Our products and services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information.

You are solely and exclusively responsible for: (a) ensuring that your completed trust document complies with all applicable federal, state, tribal, territorial, and local laws and regulations; (b) all actions taken pursuant to the trust, including but not limited to the acquisition, possession, transfer, and disposal of NFA items; (c) properly executing the trust document (signing, witnessing, notarization) in accordance with the laws of your jurisdiction; and (d) maintaining the trust and keeping it current as laws change. Firearms laws are complex and vary significantly by jurisdiction. Violations of NFA regulations are federal felonies carrying penalties of up to 10 years imprisonment and fines of up to $250,000.
We strongly recommend that you retain a licensed attorney in your state of residence — preferably one with demonstrated experience in firearms law, estate planning, or trust law — to review your completed trust document before execution. This recommendation applies to both Standard and Premium products. The cost of an attorney review is modest compared to the potential legal consequences of an improperly executed trust.
While this trust is designed for 50-state use and includes provisions addressing common regulatory scenarios, we make no representation, warranty, or guarantee that: (a) this document complies with the laws of any specific jurisdiction; (b) this document will be recognized, accepted, or enforced by any court, government agency, ATF field office, or law enforcement body; (c) the use of this document will protect you from criminal prosecution, civil liability, or regulatory enforcement; or (d) this document is sufficient for any particular legal purpose.
During the Settlor's lifetime, this Trust is revocable. Under the Uniform Trust Code Section 505(a)(1), and under the common law of most jurisdictions, property held in a revocable trust remains subject to the claims of the Settlor's creditors. Claims of "asset protection" or "lawsuit protection" for revocable trusts during the Settlor's lifetime are legally unfounded in most jurisdictions. Spendthrift and protective provisions in this trust apply only to non-settlor beneficiaries after the trust becomes irrevocable.
